These Terms of Service ("Terms") govern your access to and use of the services, website, membership programs, and events offered by the American Film Association ("AFA," "we," "us," or "our"), a membership organization headquartered in Atlanta, Georgia, founded in 2025. Please read these Terms carefully before creating an account, purchasing a membership, or registering for any AFA event.
Our Privacy Policy is incorporated into these Terms by reference. By using our services, you also agree to the collection and use of your information as described in the Privacy Policy.
By accessing our website, creating a membership account, purchasing a membership, registering for an event, or otherwise using any AFA service, you agree to be bound by these Terms. If you do not agree to these Terms in their entirety, you must not use our services.
You represent that you are at least 18 years of age and have the legal capacity to enter into a binding agreement. If you are using our services on behalf of an organization or business entity, you represent that you have authority to bind that entity to these Terms, and references to "you" include that entity.
These Terms constitute the entire agreement between you and the AFA with respect to your use of our services and supersede all prior agreements, understandings, and representations on that subject matter.
Eligibility
AFA membership is open to individuals and organizations with a professional or personal interest in the film industry, film commerce, or the creative community. The AFA reserves the right to accept or decline any membership application at its sole discretion.
Membership Tiers
We offer multiple membership tiers, each providing a distinct set of benefits:
Specific benefits for each tier are described on our membership page and may be updated from time to time. We reserve the right to modify tier benefits with reasonable notice to existing members.
Payment
Membership dues are charged on a recurring basis (monthly or annual, as selected at the time of enrollment). By enrolling in a membership, you authorize us to charge the payment method you provide for the applicable membership dues on a recurring basis until your membership is cancelled.
All fees are stated in U.S. dollars. You are responsible for any applicable taxes, and we will collect taxes where required by law. We reserve the right to change membership pricing with at least 30 days' advance notice to existing members. Price changes take effect at your next renewal date.
Payments are processed by a third-party payment processor. We do not store your full payment card details on our servers. You agree to keep your payment information current; failure to do so may result in suspension or cancellation of your membership.
Cancellation
You may cancel your membership at any time through your account dashboard or by contacting us at the address below. Cancellation takes effect at the end of your current billing period. You will retain access to membership benefits through the end of that paid period.
The AFA may suspend or terminate your membership at any time for violation of these Terms, non-payment of dues, or conduct deemed harmful to the AFA community or reputation, with or without prior notice at our discretion. In the event of termination for cause, no refund of prepaid dues will be issued.
Refund Policy
Membership dues are generally non-refundable once a billing period has commenced. If you believe exceptional circumstances warrant a refund, please contact us within 7 days of the charge and we will review your request on a case-by-case basis. Annual memberships cancelled within 7 days of initial enrollment (not renewal) may be eligible for a prorated refund. We reserve the right to make final determinations on all refund requests.
The AFA hosts a range of events including the annual Summit, the annual Gala, networking gatherings, screenings, and other programming. By purchasing a ticket or registering for any AFA event, you agree to the following:
Ticket Sales
Event tickets are sold subject to availability. Ticket prices, event schedules, and event programming are subject to change. The AFA makes no guarantee as to the availability of any particular ticket category or seating assignment.
No-Refund Policy
All event ticket purchases are final and non-refundable, except in the event that the AFA cancels an event entirely (see below). Tickets may not be transferred to another person without prior written consent from the AFA. Unauthorized resale of tickets is prohibited.
Event Cancellation
In the event that the AFA cancels an event, ticketholders will receive a full refund of the ticket purchase price or the option to apply the value toward a future AFA event. The AFA is not responsible for any incidental expenses incurred in connection with cancelled events, including but not limited to travel, accommodation, or transportation costs.
Event Rules and Conduct
All event attendees are expected to conduct themselves professionally and respectfully. The AFA reserves the right to remove any attendee from an event without refund for conduct deemed disruptive, offensive, or in violation of these Terms or any event-specific code of conduct.
Photography and Recording
By attending an AFA event, you consent to being photographed or recorded by the AFA or its authorized representatives. The AFA may use such photographs, video, or audio recordings for promotional, marketing, or archival purposes without further consent or compensation.
All content on the AFA website and in AFA materials — including but not limited to text, graphics, logos, photographs, video, audio, software, and the overall design and arrangement of the site — is the property of the American Film Association or its licensors and is protected by United States and international copyright, trademark, and other intellectual property laws.
You are granted a limited, non-exclusive, non-transferable license to access and use the AFA website and its content for your personal, non-commercial use in connection with your AFA membership or event attendance. This license does not include:
Any use of AFA content beyond the scope of this license requires the prior written consent of the AFA. Requests may be directed to the contact address below.
Members who submit content to the AFA (such as profile information, forum posts, or event photos shared with the AFA) grant the AFA a non-exclusive, royalty-free, worldwide license to use, reproduce, display, and distribute such content in connection with AFA operations and marketing.

THE AFA WEBSITE AND ALL SERVICES, CONTENT, AND MATERIALS PROVIDED BY THE AFA ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED.

The AFA does not warrant that defects in the website will be corrected or that the website or the servers that make it available are free of viruses or other harmful components. Some jurisdictions do not allow exclusion of implied warranties, so the above exclusions may not apply to you in full.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE AMERICAN FILM ASSOCIATION, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, VOLUNTEERS, SPONSORS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, REVENUE, GOODWILL, DATA, BUSINESS, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH:
IN NO EVENT SHALL THE AFA'S TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF AFA SERVICES EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT YOU PAID TO THE AFA IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100.00).
Some jurisdictions do not allow the exclusion or limitation of liability for certain damages, so some of the above limitations may not apply to you.
These Terms shall be governed by and construed in accordance with the laws of the State of Georgia, without regard to its conflict of law principles. You agree that any dispute, claim, or controversy arising out of or relating to these Terms or your use of AFA services shall be subject to the exclusive jurisdiction of the state and federal courts located in Fulton County, Georgia, and you hereby consent to personal jurisdiction and venue in those courts.
Before initiating any formal legal proceeding, you agree to contact us in good faith to attempt to resolve any dispute informally. Either party may seek emergency injunctive or equitable relief from a court of competent jurisdiction to prevent irreparable harm pending resolution of a dispute.
Any cause of action or claim you may have arising out of or relating to these Terms or your use of AFA services must be commenced within one (1) year after the cause of action accrues; otherwise, such cause of action is permanently barred.

The AFA reserves the right to modify these Terms at any time. When we make material changes, we will update the "Effective Date" at the top of this page and, where appropriate, notify you by email or through a prominent notice on our website.
Your continued use of AFA services after the effective date of any updated Terms constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must discontinue use of our services and, if applicable, cancel your membership prior to the effective date of the changes.
